Pedestrian Accident Case Basics in Washington State

Bycicle on the street

A pedestrian accident is when a person walking on a sidewalk or road is hit by a motor vehicle such as a car or truck. Pedestrian accidents are extremely dangerous and life-threatening for the pedestrian since they do not have any protection from the impact. Oftentimes pedestrian accidents result in expensive medical treatment that can easily spiral out of the injured person’s control.
Pedestrian accidents also carry a high risk of death. From 2008-2012, pedestrian accident fatalities accounted for 14% of all traffic-related death. Two-thirds of pedestrian fatalities occurred on urban roads. Risk of pedestrian fatality increased if either pedestrian or driver were distracted (such as looking at a mobile phone).

How do I know if I need a Washington State Pedestrian Accident attorney?

When you are in a pedestrian accident in Washington State, check if the driver who hit you has Personal Injury Protection (PIP) on their policy. If they do, then their PIP will cover your medical treatment and lost wages. However, since pedestrian accidents can easily max out PIP within the first few days, how then will you pay for your treatment? Your health insurance can cover you, but most plans don’t cover some types of treatment, leaving you with piles of bills.

You deserve to have your medical treatment and lost time from work paid so you will need to hire a personal injury attorney who specializes in pedestrian accidents. The Advocates at Advocates Law can work with health insurance and/or PIP adjusters to get your bills paid, or put your bills on hold if you do not have PIP or health insurance. After you are better, we will get you a fair settlement that will include all the pain and suffering you went through in the accident.

When is it too late in Washington State to file a claim on a pedestrian accident case?

In Washington State, you have three (3) years from the date of the pedestrian accident to file a claim against the driver’s insurance. After that, you will be unable to receive any compensation for your injuries. However, if you did hire a personal injury attorney he or she can file a lawsuit before your three years is up to make sure you can continue your treatment and still be compensated.

When you hire an attorney at Advocates Law, your attorney will always keep you up to date on when your case is coming up on three years. Generally, to save you time and money, your attorney will want to settle your case before the need to file a lawsuit. The Advocates have a lot of experience with this with most of their cases settling without going to court!
